Four feature articles. Four consecutive issues. April–October 2026.
My fourth feature in LexisNexis’ Corporate Rescue and Insolvency Journal:
“Unlocking the chain: how one UN Treaty transforms global logistics and trade finance – a guide for restructuring professionals” October 2026, pp. 148–153.
The timing is particularly significant. On 26 October 2026, #Accra, #Ghana, is scheduled to host the signing ceremony of the United Nations Convention on Negotiable Cargo Documents, the Accra Convention, alongside the #UNCITRAL60 high-level event.
Published ahead of that milestone, this feature examines why the Convention matters not only to international trade, but also to insolvency and restructuring professionals.
Goods do not stop moving when a business enters financial distress.
When a buyer defaults while cargo travels by road, rail, air or sea, who controls the goods? Who can direct delivery? How can their value be preserved and realised?
The article explores how negotiable cargo documents could connect cargo control, trade finance and recovery in distress across the multimodal supply chain, including:
• The document-of-title function and constructive possession.
• Electronic documents, exclusive control and paperless trade finance.
• A financier’s operational response to a buyer’s insolvency during transit.
• Opportunities for African trade corridors, the Belt and Road Initiative, Hong Kong and the Greater Bay Area.
• The legal and operational steps needed for implementation.
Signing is a milestone, not entry into force. Ratification, domestic enabling legislation and cross-border enforceability remain central to translating the Convention’s potential into practice.
I am grateful to the journal’s editorial team Helen Coverdale, REBECCA EISEMUTH, and gratefully acknowledge the assistance of Irene Cheng, Solicitor, Herman Pang, LLB Year 3, The Chinese University of Hong Kong (#CUHK); and Xin Zhuang, Juris Doctor (JD) Year 2, #CUHK.
